CIDG adds 14 respondents in Roxas blast
THE CRIMINAL Investigation and Detection Group (CIDG) has added 14 respondents in the Roxas night market bombing case.
Four of the respondents were those arrested in the two separate but joint operations in Cotabato City on Oct. 29.
Prosecutor Jay Karel Sanchez, spokesperson of the City Prosecution Office, identifies the four individuals as Mohammad Lalaog Chenikandiyil aka Datu Boi, Jackson Mangulamas Usi aka Abu Mansor/Jam, Zack Villanueva Lopez aka Haron, and Ansan Abdulla Mamasapano aka Abu Hamsa.
Sanchez, however, declined to name the 10 other respondents because they are still at large. She said they sent subpoenas to them yesterday.
The prosecutor said she is not also certain if the 14 new respondents include those eight unidentified suspects who were earlier charged last Sept. 14.
With the additional names, Sanchez said they are asking time to resolve further case.
Sanchez said they already have a resolution on the case but has to put it hold pending the new development.
“We hold the abeyance of the issuance of the resolution,” Sanchez said.
The group of the suspects arrested in the Oct. 29 operation was the third batch of suspect.
Police initially filed multiple murder and frustrated murder charges against nine still-at-large suspects – including eight other unnamed persons and a man whose identity was withheld – on Sept. 14.
Just as the panel of prosecutors handling case was about to release it resolution, police filed on Oct. 4 additional affidavit to add the second batch of suspect.
Named as respondents in the second batch are TJ Tagadaya Macabalang aka Abu Tufael, Wendell Apostol Facturan aka Muraimin and Musali Mustafa aka Mus.
They were arrested on Oct. 4 in Cotabato City in a police-army checkpoint for carrying firearms and explosives in Cotabato City as they were boarding a motorcycle without a plate number.
GRANTED
In another development, Regional Trial Court Branch 14 Judge Jill Jaugan-Lo has granted the petition of the writ for habeas corpus filed by the wife of Chenikandiyil against the Davao City Police Office (DCPO).
In the petition filed by lawyer Wilmer Donasco, the wife, name not released to the media, said her husband was arrested without a warrant last Oct. 29 by government agents inside their home in Cotabato City.
The petition said there were no charges filed against Chenikandiyil and his companions, and that their detention has exceeded the maximum period of 36 hours as allowed by the Revised Penal Code.
Chenikandiyil’s continuous detention, the complainant said, is a violation of his constitutional right.
“Assuming that a criminal case has already been filed, the same does not justify the continued detention of Mohamad Chenikandiyil and his companions considering that no inquest proceeding was taken against them,” Donasco said in the petition.
Prosecutor Sanchez said Judge Lo’s decision granting the writ for habeas corpus has no bearing the resolution of the case.
