BIFF claims it intrudes into Army camp in Maguindanao; Army says ‘it’s just propaganda’

Armed followers of a Moro revolutionary faction were able to penetrate this week into a major military camp in Maguindanao and reportedly confiscated some small weapons from government soldiers, the group said.

But the Army’s Sixth Infantry Division belied the claim of the Bangsamoro Islamic Freedom Fighter, a breakaway group from the Moro Islamic Liberation Front, which was on tract to conclude a comprehensive peace settlement in Mindanao.

The BIFF spokesman, Abu Misry Mama, told DavaoToday on Friday, that its fighters were able to intrude into a portion of the  Camp Brig. Gen Gonzalo H. Siongco, headquarters of the 6th ID at Awang, Datu Odin Sinsuat, Maguindanao.

“We have seized two .45 caliber pistols and one M16 rifle during our offensive operation,” he said.

Mama said the BIFF carried out the incursion on Tuesday, the same day that a bomb went off inside the Rural Transit Bus which claimed the lives of 11 and injured 42 others, including —whom majority of the victims were college students from Central Mindanao University.

(The military blamed the BIFF for the bomb explosion inside the bus and quickly identified some BIFF leaders as behind the explosion.  Mama belied the allegation saying that it was not their practice to attack civilian targets.)

Mama did not reply however, when sought for details of the BIFF attack of the 6th ID Camp Siongco.

Col. Dickson Hermoso, spokesman of the Army’s 6th ID, dismissed the BIFF claim and said that “there’s no official incident report that Bangsamoro Freedom Fighter has intruded and disarmed army troopers last Tuesday”‘.

“There is no truth to that because the BIFF’s pronouncement was all propaganda,” he said.

Instead, Hermoso went back to the bus bomb explosion to emphasize that BIFF had carried out the bomb attack on the bus. “BIFF is the prime suspect in the bus bombing.”

“Ultimately, the laws will catch up with these criminals. Numerous arrest orders against BIFF leaders and members have issued already and in due time they will serve their jail time. They must answer their crimes committed against the people,” Hermoso added.

Four government soldiers were injured following a roadside bombing on Monday in Compostela Valley province, a stronghold of communist rebels in southern Philippines, reports said.

It said the soldiers were travelling on a truck when the bomb, believed planted by the New People’s Army, went off on a highway near the village of Cabuyoan in Mabini town.

There was no statement from either the military or the NPA, but the attack came at the same time that the Armed Forces of the Philippines and the Philippine National Police declared a month-long yuletide ceasefire.

The unilateral truce would allow troops and policemen to celebrate the holiday season with their families, but the cease-fire will not affect ongoing law enforcement operation against the rebels and their supporters.

The NPA has been waging a separatist war for decades now and previous peace talks had failed many times after both sides disagreed with each other demands – with the communist group demanding the release of all imprisoned leaders and rebels, including political prisoners, and the government asking the guerrillas to lay down their weapons as a gesture of goodwill.

Suspected rebels allegedly burned equipment and destroyed some plants in a farm in Nabunturan town in Compostela Valley on Sunday evening, a report from the local police there said.
 
In its initial investigation, the Nabunturan Municipal Police Station said that around 20 armed rebels protesting landgrabbing in the area entered the Dizon Farms compound at around 8 p.m. Sunday, disarming five security personnel on duty.
 
The rebels were "angry and accused the Dizon management of grabbing lands from the poor land owners" at the neighboring town of Mawab, the police report said.
 
They then burned four farm tractors, two 10-wheeler trucks, one six-wheeler truck, and one generator set, it added.
 
The rebels cut down an "undetermined number" of banana plants before they "fled towards unknown direction" in two sports utility vehicles (SUVs).
 
They "carted" with them the security's firearms, including two 12-GA shotguns, and two caliber-38 revolvers, the police report said.

The Department of Foreign Affairs on Monday sought full cooperation from the United States after the Olongapo City Prosecutor’s Office filed a case for murder against US Marine PFC Joseph Scott Pemberton for the death of Filipino transgender woman Jeffrey "Jennifer" Laude.

“The Prosecutor's investigation proceeded with all deliberate speed. We now await the decision of the court on the issue of probable cause and for the next steps to proceed,” a DFA statement issued by Foreign Affairs spokesman Charles Jose said.

“In accordance with the Visiting Forces Agreement (VFA), we look forward to the full cooperation of the US government in ensuring that justice is secured for Jeffrey "Jennifer" Laude,” it added.

Citing the VFA, US military authorities took custody of Pemberton, who was the last person seen with Laude before she was found dead on the night of Oct. 11 in an Olongapo City motel.

The U.S. Marine's involvement as a primary suspect in the recent killing of Laude has reignited anti-US sentiments and has revived calls for the abrogation of the Visiting Forces Agreement.

The VFA provides for the conduct of joint military exercises between Filipino and American troops in Philippine territory.

Article 5 pertaining to criminal jurisdiction of the VFA states that "custody of any United States personnel over whom the Philippines is to exercise jurisdiction shall immediately reside with United States military authorities, if they so request, from the commission of the offense until completion of all judicial proceedings." 

Pemberton, 19, who took part in military exercises that involved more than 3,500 American military personnel, was initially held on board the USS Peleliu.

After consultation by U.S. and Philippine authorities, American officials agreed to discreetly transfer him to a container van at the Aguado compound in Camp Aguinaldo, where he is currently being guarded by U.S. Marines.

The Bangsamoro Basic Law (BBL) was one of the agenda of a regular meeting of teachers belonging to the Lamitan West-1 District held on December 11, 2014 at San Jose Elementary School, Lamitan City, Basilan. The district is under the supervision of Hja. Aida T. Alih, Ed. D., School Division Superintendent.
   
According to Mr. Domingo G. Lardizabal, District In-charge, “It is so important that BBL is included in this meeting so that teachers could be enlightened and can be cleared of their doubts especially their employment status under the Bangsamoro Transition Authority (BTA) period as rumors are being scattered in all walks of life that the teachers will be terminated upon the advent of BTC”.

Former House Deputy Speaker Gerry A. Salapuddin, Majid A. Nur, member of the BLM Steering Committee and Ibno A. Saddalan, Basilan Provincial Information Director were invited as speakers.

Salapuddin, also former Basilan Governor said, “Without peace even if you have a beautiful house and good business you are not secured. BBL is a political agreement to end the war in the south. If it is passed by congress it is the key to peace and development which have been deprived of us because of conflict.”

“Peace was so elusive the past four (4) decades”, he said further.

Mr. Nur quoting the statement of Cagayan De Oro Mayor Cesar Moreno when he met him on September 23, 2014 at his office in CDO that said, “The country should give some portion of Mindanao which presently called the ARMM. The Philippines as whole was once ruled by Muslims prior to the coming of the Spaniards”.

A certain Ms. Reyna asked, “What will happen to the areas that will vote no during plebiscite, can they still avail benefits from the Bangsamorio? Salapuddin answered, “Yes they can still avail regular benefits from the Central Government but not from the Bangsamoro Government just like Isabela City”.  “Mayor Cherrylyn Santos has been requesting some projects from the ARMM’s Regional Governor Office but turned down because Isabela City is not part of ARMM.”

At the end of the meeting, Mr. Lardizabal expressed his heartfelt gratitude to the speakers as they were so honored and well-enlightened because their ‘agam-agam’ or doubts had been clarified. The teachers, better known as modern day heroes or heroine for molding the youth parted ways with smiles on their faces as their concerns were addressed by the speakers.

Sa pinakahuling krimen ng pamamaslang sa loob lamang ng dalawang (2) linggong sa buwan ng Unibersal na Deklarasyon ng Karapatang Pantao ay nagtala agad ng panimulang rekord ng apat (4) na kaso ng pamamaslang sa iba-ibang desenyo ng operasyong saywar.

Disyembre 4, 2014 alas-5:00 ng hapon dinukot si Samuel Dollesin na taga-brgy Lapinig, Gubat, Sorsogon sa katabing baranggay ng Sogod, Bacon District, Sorsogon City. Marami ang saksi sa presensya ng operasyon ng Philippine Army sa lugar at sa mismong pantoturtyur ng mga lasing na sundalo sa biktimang si Dollesin. Matapos ang ilang araw na paghahanap ng pamilya sa tulong ng mga tagapagtaguyod sa karapatang pantao natagpuan itong nakalibing sa isang hukay sa nasabing baryo noong Disyembre 8, 2014.

Disyembre 8, 2014 ng gabi pinagbabaril naman si Boyet De la Cruz, 23 taong gulang sa brgy Abuyog, Sorsogon City habang naka-duty ito bilang tanod sa nasabing baranggay. Nadamay pa sa sinasabing pamamaril ang babaeng nagngangalang Marie Hagus, 50 taong gulang na nakatira sa malapit sa pinagyarihan ng krimen.

Disyembre 12, 2014 binaril naman si Susan Limicerio Cagalitan, 60 taong gulang sa kanyang bahay sa baranggay bugtong, Barcelona, Sorsogon. Alas-11:00 ng gabi kumatok sa kanilang pintuan ang mga salarin at nagkaroon ng 20 minuto pagtatalo hinggil sa kanyang asawang matagal ng hiwalay sa pamilya. Wala sa katotohanan pinaghinalaang nila itong kasapi ng NPA at pinagbibintangang may kaalaman ito sa pangyayaring ambus ng tropa ng CMC-NPA Sorsogon na naganap na malapit sa kanilang bahay.

Disyembre 14, 2014 pinagbabaril si Anacleto Laceda ng brgy Sta Cruz, Casiguran, Sorsogon sa brgy Balogo, Sorsogon City habang ito ay naglalakad pauwi sa pansamantalang tinutulayan nito sa nasabing baranggay nang wala pang klarong dahilan sa ngayon kundi nangyari ito sa malapit sa checkpoint ng PNP.

Saksi ang pamilya ng mga biktimang sibilyang ito, sa lansakang paglabag ng 31st IBPA sa karapatang pantao at paglabag sa batas ng kondukta ng digma. Ang ipinagmamarali nilang ilang kaso ng mabuting pagtrato sa NPA na nahuli mula sa maraming kaso ng paglabag ay dulot ng pagkakadepensiba sa propaganda.

Dulot ito ng aktibong pagtupad ng ahensya sa karapatang pantao,opisyal ng mga yunit sa lokal na gobyerno, institusyon ng hudikatura, media at mamamayang Sorsogueno na matagal nang malakas ang tindig sa pagkilala sa karapatang pantao.

Nananawagan po muli ang Celso Minguez Command (CMC) ng Bagong Hukbong Bayan sa mamamayan ng Sorsogon at buong samabayan na ipagpatuloy natin ang tradisyon na manindigan sa karapatan, katarungan at kapakanan ng ating mamamayan.

With or without China’s response the case proceeds and a decision is expected by early 2016. A comprehensive strategy will give Manila more leverage in this geopolitical chess game.

Olongapo prosecutors filed a murder case against a US marine over the killing of Filipino transgender woman Jennifer Laude.
 
Olongapo City Chief Prosecutor Emilie Fe de los Santos told reporters on Monday, December 15, that the prosecution panel recommended that US Marine Private First Class Joseph Scott Pemberton be charged with murder, not the lower charge of homicide.

De Los Santos said that the prosecution found “aggravating qualifying circumstances” that showed that Laude’s killing was a murder.

“It’s a capital offense so there will be no bail. There was aggravated treachery, abuse of superior strength and cruelty. That counts as a qualifying circumstance. Because you have those 3 aggravating qualifying circumstances… it’s murder,” De Los Santos said.

De Los Santos said that the recommendation is detailed in a 23-page resolution. The case was already raffled off, and lawyers said they are expecting the issuance of an arrest warrant soon.

Harry Roque, lawyer for the Laude family, called the filing of the case “a huge victory.”

Roque said that the case was crucial because it concerned the Philippines’ military deal with the United States, the 1998 Visiting Forces Agreement (VFA).

“This means the private complainant proved not just the killing of Laude but that she was killed in a brutal manner,” Roque said. “This is the first step to justice. This is not an ordinary case but it’s under the VFA. The question is: where will Pemberton be detained? Will he be handcuffed and brought to face the court?”

Last week, the Laude camp filed a motion asking De Los Santos to inhibit from the case, citing the city prosecutor's alleged bias and hostility against the Laude family's lawyers.

Roque told Rappler that he had been able to speak with De Los Santos after she announced the decision to file murder charges against the US marine.

But he added that their motion asking for another prosecutor to handle the case remains.

Slammed for 'special treatment'

Roque and the Laude family have slammed what they called the special treatment of Pemberton, who is under US custody based on the VFA.

The VFA states that custody will remain with the US until “the completion of the judicial proceedings.” Yet the agreement also provides that the Philippines may request for custody in “extraordinary cases.” The Philippines has said it may seek custody over Pemberton once a warrant is issued, a request that the US can opt to deny.

The Philippine Department of Foreign Affairs said Monday that it will await the court’s decision on probable cause, and “the next steps to proceed.”

“In accordance with the VFA, we look forward to the full cooperation of the US government in ensuring that justice is secured for Jeffrey ‘Jennifer’ Laude,” said DFA spokesperson Charles Jose.

Pemberton is detained at the Philippine military headquarters but the US keeps custody over him.

Witnesses said Pemberton and Laude met at a disco bar in Olongapo City on October 11. Laude was later found dead in the bathroom of a motel room.

The case fanned anti-American sentiment, and led to renewed calls to abrogate the VFA on the grounds that it is supposedly lopsided in favor of the US.

Observers compare the Laude case to the 2005 rape case of Suzette “Nicole” Nicolas involving 4 US marines led by Lance Corporal Daniel Smith also in Olongapo City. A Philippine court convicted Smith but “Nicole” later recanted her testimony, leading to his acquittal by the appeals court.

‘No special treatment’

Laude’s sister, Marilou, said she was grateful for the prosecutors’ recommendation.

“I am glad that the case of murder is filed and I hope the court will be stricter and ask for the cooperation of the lawyers and the accused,” Marilou Laude told reporters.

Akbayan Representative Walden Bello, who was also present in court on Monday, said there must be no special treatment for Pemberton.

“This has been a big victory for the Laude family, the [legal] team, and the Filipino people. Justice must be done for the Laude family, for the country.”

“This shows that this arrangement like the VFA is not good for our citizens and for our country. I repeat the call of that there should be no special treatment for Pemberton. He should be treated as a on ordinary person being prosecuted,” Bello said.

The Office of the Solicitor General on Monday, December 15, filed before the Supreme Court the government's 42-page memorandum in the cases filed against the new Philippine-US military deal that allows US troops to construct facilities inside Philippine military bases and preposition defense assets in the country.

Various groups had asked the High Court to declare the executive agreement unconstitutional based on two grounds – procedural and substantive. The first refers to the supposed necessity for Senate to concur with the agreement, while the second refers to what is seen as a lopsided deal in favor of the Americans.

The government argued against suggestions made during the oral arguments in November to submit the Enhanced Defense Cooperation Agreement (EDCA) to the Senate for its concurrence. (READ: Transmitting PH-US military pact to Senate discussed at SC)

It argued that only the incumbent senators have the legal standing to protest EDCA before the Supreme Court. In spite of Senator Miriam Santiago’s vocal opposition, it noted that she nor any other incumbent senator joined the anti-EDCA petitioners in their protest before the Supreme Court. 
 
It is also within the powers of the President to enter into an "executive agreement," the memorandum added. It is supposedly different from a "treaty" and "international agreement" that expressly requires Senate concurrence based on the constitution.

The government reiterated that EDCA is a mere implementation of existing treaties, the Mutual Defense Treaty (MDT) and the Visiting Forces Agreement (VFA).

The memorandum also addressed the substantive issues raised against EDCA. It assured the critics that the "Agreed Locations" will not lead to the return of US military bases in the Philippines. On this basis, there is no reason to ratify the agreement, it added.

The memorandum gives both parties the last opportunity to argue their positions before the Supreme Court justices rule on the case. The anti-EDCA petitioners have yet to submit their memorandum.

Embarass the President?

Acting Solicitor General Florin Hilbay said a referral to the Senate will diminish the President's powers and will result in "international embarassment for the President, adversely affecting the country's standing in the international community."

It will also cause "plain and simple delay" because the petitioners are bound to bring EDCA back to the High Court even if the Senate concurs with the agreement, Hilbay added. It will only address the procedural issues, not the substantive issues.

“In choosing to enter into the EDCA, the President has made the decision to formalize pre-existing licenses into a framework agreement that clarifies the rights and obligations of the parties. Such decision is in response to the implementation gaps that the government seeks to address through the EDCA,” said Hilbay.

Aside from maritime security, the memorandum highlighted the value of prepositioned US defense assets to humanitarian assistance and disaster response. It cited US assistance to the victims of Super Typhoon Yolanda (Haiyan). (READ: SolGen: EDCA no guarantee US will aid PH in sea dispute)

President Benigno S. Aquino III told the fresh graduates of the Armed Forces of the Philippines’ (AFP) Officer Candidate Courses not to give in to temptations as they perform their new role as military officers.

"Ibang klaseng tapang at dangal din ang hihilingin sa inyo sa pagharap sa tuksong maaaring makaengkuwentro habang nagsisilbi sa bayan. May mga magtutulak ng sobreng hitik sa salapi, kapalit ng pirma. May mga magtatangkang padaliin ang buhay ninyo, kapalit ang prinsipyo," the President said during his speech at the officers’ graduation ceremony held at the AFP Theater, Camp Aguinaldo in Quezon City.

"Alam kong gagawin ninyo ang tama, dahil tiwala akong nakikita ninyo ang magandang bunga sa pagtahak natin sa tuwid na daan," he said.

President Aquino noted that as officers, more are expected of them.

“Magkakaroon ng mga pagkakataon kung kailan buhay ng inyong mga kapwa-sundalo ang nakataya sa inyong desisyon. Sa panahon ng pangangailangan, sa inyo babaling para sa direksyon at inspirasyon ang inyong hanay. Higit sa lahat, sa harap ng taumbayan, kayo ang magiging mukha ng Sandatahang Lakas ng Pilipinas,” he said.

The President said that as new officers, their main tasks not only involve facing terrorists and bandits but leading rescue operations during disasters, as well.

Yet despite all their efforts, he said, they could be the subject of criticisms as well.

“Ngunit hindi naman parangal at papuri ang habol natin nang pumasok tayo sa serbisyong pampubliko, di po ba? Basta’t makatulong ka, sapat na iyon; basta’t makaambag ka sa positibong pagbabago, sapat na iyon,” he said.

During the ceremony, the President presented the Presidential Saber Award to 2nd Lt. Rodel Bacquial (Army), 2nd Lt. Kenneth Aquino (Air Force), and Ensign Cathleen Joy Cruz (Navy); the Secretary of National Defense Saber Award to 2nd Lt. Noccolo Bayona (Army), 2nd Lt. Reden Jane Hucalla (Air Force), and Ensign May Joy Allauigan (Navy); and the Chief of Staff Saber Award to 2nd Lt. Cristinson Caampued (Army), 2nd Lt. Ronnie Rizal (Air Force), and Ensign Kristia Marie Villegas (Navy).

To the awardees, he said, “Sa pagsulong ng inyong mga karera, kayo ang magiging pinuno ng kasundaluhan. Nawa’y marangal ninyong tanganan ang mga espadang ipagkakaloob sa inyo sa araw na ito."

For his part, AFP Chief of Staff General Gregorio Pio Catapang congratulated the new officers and told them: "You have what it takes to be fine soldiers."

Present during the ceremony were Defense Secretary Voltiare Gazmin; Lt. General Hernando Iriberri, Commanding General of the Philippine Army; Lt. General Jeffrey Delgado, Commanding General of the Philippine Air Force; and Vice Admiral Jesus Millan, Flag Officer-in-Command of the Philippine Navy, and other military officers.

A total of 146 students of the course graduated and joined the military as second lieutenant and ensigns. Of the figure, 65 joined the Army, 47 joined the Navy, and 34 joined the Air Force.

President Benigno S. Aquino III will lead Thursday the ceremony to pay tribute to men and women of the military, as the Armed Forces of the Philippines (AFP) celebrates its 79th Day Anniversary.

Presidential Spokesperson Edwin Lacierda said the President will deliver a speech during the event.

Lacierda said President Aquino will also lead the presentation of awards to AFP officials and employees who have rendered exceptional service to the country.

“This week, the President recognized the service of the men and women of the AFP,” he said in a statement.

Lacierda said the Chief Executive attended Monday morning the joint graduation ceremony of the Officer Candidate Courses, where he distributed diplomas and presented Presidential Sabers to three outstanding graduates from each AFP major service.

Established in the Army, Air Force and Navy, candidate schools train civilians and AFP-enlisted personnel with baccalaureate degrees to be future officers of the AFP regular force.

He said the President will later attend the Solemn Eucharistic celebration of the 25thanniversary of the dedication of the Shrine of Mary, Queen of Peace, Our Lady of EDSA.

Also this week, Lacierda said President Aquino will attend the Kristiyanong Kabataan para sa Bayan (KKB) Movement’s Youth Summit and the Pasko ng Batang Pinoy 2014.

As the youth arm of the Jesus is Lord (JIL) Church Worldwide, he said the KKB Movement aims to contribute to the formation of upright and conscientious Filipinos.

“Similarly, the Pasko ng Batang Pinoy 2014—one of the Paskuhan activities organized by the Department of Social Welfare and Development (DSWD)—endeavors to promote good values among the country’s children, and deter them from going out into the streets to ask for alms,” Lacierda added.

The Department of Foreign Affairs on Monday lauded the speedy investigation conducted by the Olongapo City Prosecutor’s Office, which filed formal murder charges against a US Marine who was tagged in the killing of transgender woman Jeffrey “Jennifer” Laude.

Citing "aggravating qualifying circumstances," the city prosecutor determined probable cause on US Marine Private First Class Joseph Scott Pemberton’s involvement in the murder case.

"We now await the decision of the court on the issue of probable cause and for the next steps to proceed,” a DFA statement issued by Foreign Affairs spokesman Charles Jose said.

“The Prosecutor's investigation proceeded with all deliberate speed,” the DFA said, as it sought full cooperation of the US government in ensuring that justice is secured for Laude.

Pemberton, 19, was identified as the main suspect in the killing of Laude, who was found dead inside the toilet of an inn in Olongapo City. He was the last person seen with Laude, 27, on the night she was found dead.

The US serviceman is in the custody of US authorities, but currently detained at a Philippine military facility in Camp Aguinaldo.

The Philippine government on Monday welcomed the publication by the U.S. government of a study denigrating China’s massive claim in the resource-rich territories.

In the study by the US State Department, called China’s Maritime Claims in the South China Sea (SCS), it concluded that Beijing’s nine-dash-line “does not accord with the international law of the sea.”

Washington’s findings add an important voice to Manila’s position that China’s claims are baseless and violates international law.

“The study’s factual account and analyses support the Philippines position on the need for peaceful clarification of maritime entitlements in the South China Sea, which the Philippines is seeking through third-party arbitration under United Nations Convention on the Law of the Sea,” a DFA statement said. UNCLOS – a 1982 accord signed by the Philippines, China and more than 100 other states, gives maritime nations the right to develop, explore and exploit areas within its designated exclusive economic zone or EEZ.

Defying China’s opposition, Manila has filed an arbitration against Beijing before a Netherlands-based tribunal to try to declare as illegal its nine-dash claim – a tongue-shaped encirclement that covers almost the entire South China Sea, including areas that are within Philippine territory or EEZ.

“The Philippines continues to advocate for a peaceful and rules-based settlement of disputes in accordance with universally recognized principles of international law,” the DFA said.

Studies such as the one produced by US Department of State, the DFA noted, “contribute to the substantive literature that supports the primacy and utility of the UNCLOS for the determination of maritime entitlements, and the peaceful settlement of maritime disputes.”

China insists indisputable and historical ownership to almost 90 percent of the sea, where huge gas, oil and mineral deposits have been discovered in several areas. Vietnam, Malaysia, Brunei and Taiwan also claim the South China Sea in parts or in whole.

The Armed Forces of the Philippines (AFP) will celebrate its 79th founding anniversary in a ceremony at its headquarters in Camp Aguinaldo, Quezon City on December 18.

This year’s anniversary is anchored with the theme “Sandatahang Lakas: Ika-79 Taong Tapat na Naglilingkod Tungo sa Kapayapaan, Kasaganahan at Kaunlaran”.

President Benigno S. Aquino III, AFP Commander-in-Chief, is the guest of honor and speaker.

The President will be joined by Secretary of National Defense Voltaire T. Gazmin and AFP Chief of Staff, General Gregorio Pio P. Catapang Jr.

The military aims to highlight the ongoing implementation of the AFP Transformation Roadmap and the achievements of the AFP Internal Peace and Security Plan (IPSP) "Bayanihan" through a series of activities that will be open to the public.

The AFP Anniversary Program will also include an awarding ceremony to give due recognition to deserving AFP Units, Military Officers and Personnel, Civilian Employees and ROTC Cadets.

It will be culminated with a Parade and Review of the AFP’s assets including motorized contingents from the Major Services, the AFP’s Humanitarian and Disaster Response (HADR) equipment, and brand-new equipment acquired through the AFP Modernization Program.

The anniversary kicked off Sunday with its "Bayanihan Run 2014" at the Quirino Grandstand, Manila.

A battalion size contingent each from the Philippine Army, Philippine Air Force, Philippine Navy, General Headquarters, and Philippine Military Academy participated in the competition.

The 800-strong runners tracked about six kilometers from The Heritage Hotel Manila to Quirino Grandstand within 45 minutes.

The Philippine Air Force grabbed all three trophies for Best in Cadence, Best in Chanting, and Best in Uniform.

They were judged by officers from the GHQ Technical Service.

The all-military running competition is one of the highlights of the series of activities in line with the upcoming 79th AFP Anniversary.

It was aimed at showcasing the physical prowess, team work and camaraderie among soldiers, and spreading the message of "Bayanihan" to the public.

The Armed Forces of the Philippines (AFP) on Monday announced that the Suspension of Military and Police Operations (SOMO), for the coming Yuletide Season, will take effect this Dec. 18 up to Jan. 19.

"We would like to announce that upon the recommendation of the AFP as concurred to by the Philippine National Police and favorably endorsed by the Department of National Defense, the President has approved the Unilateral Declaration of Suspension of Military and Police Operations against the CPP-NPA from midnight of 18 December 2014 to midnight of 19 January 2015," AFP spokesperson Col. Restituto Padilla said.

The declaration of the SOMO against the NPA will highlight the government’s sincerity to pursue peace.

"However, the AFP and PNP forces engaged in law enforcement operations, Humanitarian Assistance and Disaster Response (HADR) and defensive operations which include security of vital installations and infrastructure projects will continue their current posture and will continue to operate to ensure the safe and secure celebration of the Yuletide Season," he added.

Padilla said the AFP will continue to undertake active security operations and proactive actions to secure civilian communities, government establishments, investment facilities, vital installations and military bases.

"Support operations will also be sustained to assist the civil authorities, government instrumentalities and other agencies and their mandate for peace, development and humanitarian assistance programs," he said.

Operatives from the Armed Forces of the Philippines (AFP) and Philippine National Police (PNP) have successfully arrested a ranking New People's Army (NPA) rebel during operations in Pantukan, Compostela Valley Sunday afternoon.

The operation took place at 5: 35 p.m., 10th Infantry Division spokesperson 1st Lt. Vergel Lacambra said

The rebel was identified as Jordan Donillo alias "Noli".

He was arrested in Barangay Magnaga, Pantukan by virtue of Warrants of Arrest docketed as Criminal Case Nr 5648 for the crimes of Double Murder and Multiple Frustrated Murder and Criminal Case Nr 4872 for Robbery in Band both issued by RTC 11TH Judicial Region, Branch 3, Nabunturan, CVP.

He has also warrants of arrest for the following crimes: CC Nr 7662-13 for Attempted Murder issued by RTC 11, Branch 10, Ecoland, Davao City; CC Nr 2870 for Robbery in Band with Multiple Frustrated Murder issued by MTC New Bataan; and CC Nr 5295-08 for Murder issued by RTC 11, Branch 6, Mati City.

He was once apprehended by the PNP in CY 2002 by virtue of the warrants of arrest for criminal cases stated above but was deliberately rescued by his cohorts in the New People’s Army on the same year in Tagum City while en-route for the arraignment of his cases.

His notoriety can be traced back when he led his NPA unit in attacking San Isidro Municipal Police Station on 22 August 2007 and Davao Oriental Provincial Jail in Mati City on 19 May 2008.

He also led the attack of Banay-banay Municipal Police Station on 03 July 2008 and the arson of Bachelor Bus in Banay-banay last CY 2009. On 24 May 2010, he also led the attack of a military temporary patrol base of 28IB in Sitio Chapter, Barangay Maputi, Banay-banay.

These atrocities and terroristic operations resulted to the killing of three soldiers and wounding of four and one police officer and damaging civilian properties worth millions of pesos.

Donillo is member of the Special Operations Group of the NPA’s National Military Command who kept track for killing retired General Jovito Palparan in Metro Manila in CY 2000 before he was reassigned to lead the NPAs here in Compostela Valley Province.

He held the position as Vice CO of PBC 1 as @PARAGU’s deputy in CY 2005; as Secretary of Guerilla Front 18 of the Southern Mindanao Regional Committee (SMRC) from CY 2006-2010; CO of PBC6 operating in Davao Oriental from 2011-2013.

At the time of the arrest, Jordan Donillo functions as the Commander of the main guerilla force of Guerilla Front 18 with Php 2.5M cash reward for his arrest per DND-DILG Joint Order on Reward Nr 14-2012.

10th Infantry Division commander Major Gen. Eduardo M. Año, lauded the efforts of the AFP and PNP personnel involved in the arrest of Donillo and considers it a “major victory in the campaign to bring justice to the victims of terroristic activities by the CPP-NPA.”

Año also assured the public that Donillo will be accorded his rights to due process. He is now detained at CIDU, Region XI, Davao City.

Malacanang on Monday said the declaration of one-month ceasefire will enable Filipinos enjoy the spirit of yuletide season and the New Year in peace.

Presidential Spokesperson Edwin Lacierda said the implementation of Suspension of Offensive Military Operations (SOMO) and Suspension of Offensive Police Operations (SOPO) from Dec. 19 to Jan. 19 is in line with the Philippine government Christmas tradition.

“Government has always wished to provide for our people's peaceful and joyful celebration of this holy season and a hope-filled welcome to a new year,” Lacierda said, quoting Presidential Adviser on the Peace Process Secretary Teresita Quintos-Deles.

Further, Lacierda said cessation of hostilities will likewise allow unhampered rehabilitation of calamity-affected communities.

“It will also set the tone for the much-anticipated Papal visit in January. With the silencing of guns, our preparations for and celebration of Pope Francis' visit may be carried out with undistracted prayers and deep hope for abundant blessings to be showered on our people,” he added.

The one-month yuletide ceasefire was jointly announced by the Armed Forces of the Philippines (AFP) and Philippine National Police (PNP).

Troopers from the Capiz-based 3rd Infantry Division are now conducting pursuit operations against the New People's Army (NPA) fighters who torched engineering equipment belonging to a private company in Negros Occidental Sunday night.

The unprovoked attack took place at 8:35 p.m. at Sitio Taoangan in Barangay Gil Montilla, Sipalay City, Negros Occidental, 3rd Infantry Division spokesperson Major Ray Tiongson said.

The equipment was owned by International Builders Corporation.

Lt. Col. Pompeyo Jason Almagro, 47th Infantry Battalion commander, said around 30 armed NPA rebels burned one grader, one payloader and one vibratory roller using combustible materials.

The equipment destroyed by the NPA was used for construction and rehabilitation of the national road which is a government project that could boost trade and economic development in Sipalay City.

It was gathered that the atrocity was another extortion attempt of the NPA to force the private firm to give protection money.

Communist rebels tried, but failed to overrun a military installation in a far-flung village here Sunday night, police said.

About 30 heavily armed New Peoples’ Army armed with rifle grenades and assault rifles surrounded a military detachment in Barangay Lampagang, Tulunan, North Cotabato and simultaneously opened fire at past 8 p.m.

Alert militiamen and soldiers returned fire, triggering a 15-minute fire fight until the attackers fled when reinforcement from the 39th Infantry Battalion arrived, according to Senior Insp. Rolando Dillera.

”Nobody was hurt in the incident on the government side,” Dillera said, adding that it was uncertain if the attackers suffered fatalities.

Dillera said the attackers belonged to the Front 72 Far South Mindanao region who have been opposed to the military’s peace and development outreach program (PDOP) in Tulunan’s remote villages.

The Army’s 39th Infantry Battalion had been conducting PDOP in at least 17 communities in Tulunan to help villagers fight poverty and ensure development.

More than two dozens of NPA initiated attacks have been recorded by police in Tulunan and nearby town of Makilala, known NPA infiltrated towns.

Tulunan, a second class municipality in the province of Cotabato with a population of 54,884 people based on the 2010 census. Most of its 29 villages were believed to have been infiltrated by communist guerrillas operating in the borders of North Cotabato and Davao del Sur.

At least 50 suspected members of the New People’s Army (NPA) burned three heavy equipment of a private contractor Sunday evening at Sitio Taw-angan, Barangay Gil Montilla, Sipalay City, about 170 kilometers south of this city.

Damaged were a grader, a payloader, and a vibratory roller at the batching plant of International Developer Corp. (IDC) owned by Alfonso Tan of Pavia, Iloilo.

The IDC is doing road construction works in southern Negros Occidental.

Supt. Luisito Acebuche, city police chief, said heavy equipment worth about Php5 million were damaged during the atrocity that took place around 8:30 p.m.

Police operatives put the fire under control with assistance from the city’s fire station, he said.

Senior Supt. Milko Lirazan, director of Negros Occidental Police Provincial Office, said the police and the Philippine Army are tracking down the fleeing rebels.

In previous months, the NPA rebels also burned heavy equipment of Maricalum Mining Company in Barangay San Jose, Sipalay City.

The prosecutor here on Monday charged U.S. Marine Private First Class Joseph Scott Pemberton with murder in connection with the killing of Filipino transgender Jeffrey "Jennifer" Laude.

City prosecutor Emily delos Santos said the prosecution panel found probable cause in the slaying of Laude whose body was found in a hotel on the night of October 11, this year.

Delos Santos, citing a 23-page resolution, said the prosecution panel found aggravating circumstances that included treachery, abuse of superior strength and cruelty.

"It's murder," de los Santos told reporters after filing the non-bailable charge against Pemberton before a regional court.

“You can see the kind of cruelty she (victim) endured, the injuries she sustained. We believe we have a strong case,” she said.

Harry Roque, the legal counsel of Laude's family, welcomed the prosecutors' ruling and demanded that Pemberton be placed into a regular jail.

Pemberton is presently detained at a facility jointly managed by the Philippine and US governments in the Armed Forces of the Philippines’ general headquarters in Quezon City.

The AD HOC Committee on House Bill No. 4994 also known as the Bangsamoro Basic Law, together with organization sector representatives and stakeholders, conducted a public hearing and consultation in Iloilo Provincial Capitol on Monday.

This consultation started in Central Mindanao last Oct. 22-24, 2014, then in Zamboanga City last Nov. 14 and other parts of Mindanao regions. The Ad Hoc also went to Buluan in Maguindanao, Davao City, North Cotabato and in Butuan on the 10th to 13th of December.

According to Rep. Niel Tupas, Jr. (5th District) during the preliminary organization meeting last Sept. 16, the committee agreed that BBL public hearing and consultation would only be conducted in Mindanao, especially in the core areas and the neighboring provinces. But due to the “change of heart”, they include Laoag and Baguio City which simultaneously conducted the consultation last Dec. 5 and now Iloilo and Cebu are having this simultaneous BBL consultation.

This consultation, according to Rep. Jesus N. Sacdalan, is being served to the people whose lives are directly affected by the proposed measures.

“This will also give opportunity for the people to fully understand the various measures of BBL that they will be properly informed, “Sacdalan said.

Meanwhile, during the consultation, various committees extended their support for this draft law. One of these is Provincial Capitol Human Resource Management and Development Officer-in-Charge, Alma Ravena , who also represented the Region 6 Gender and Development Committee.

She said that they would provide support for the passage of this Basic Law, however, they wanted to make few points of the certain provision for the law, specifically, stating the participation and inclusion of women.They will submit a position letter for this.

Bangsamoro Basic Law if passed will be the transition from the Autonomous Region in Muslim Mindanao and will become a new political entity to provide peace and harmony in Mindanao.

Governor Arthur Defensor, Sr. said, “This law will provide peace not only in Mindanao but also to Luzon and Visayas and Ilonggos must also have knowledge about this for we cannot support this law wisely unless we understand it.”

The Iloilo BBL consultation has been the 32nd consultation conducted and probably the last out of town hearing.

The Armed Forces of the Philippines (AFP) on Monday declared a monthlong suspension of military operations (Somo) against the New People’s Army, the armed wing of the Communist Party of the Philippines.

“We would like to announce that upon the recommendation of the AFP, as concurred by the Philippine National Police, and favorably endorsed by the Department of National Defense, the President has approved the Unilateral Declaration of Suspension of Military and Police Operations against the CPP-NPA from midnight of December 18 to midnight of January 19, 2015,” AFP chief General Gregorio Catapang Jr. told reporters.

Catapang noted, however, that in the unilateral Somo, security forces engaged in law enforcement operations, humanitarian assistance and disaster response and defensive operations, which include security of vital installations and infrastructure projects, will continue their current posture to operate to ensure the safe and secure celebration of the Yuletide season.

The Philippine government is battling about 4,000 NPA members, mostly in Mindanao.

“The AFP will continue to undertake active security operations and proactive actions to secure civilian communities, government establishments, investment facilities, vital installations and military bases,” he said.

The ceasefire period will end on the last day of the Pope’s visit in 2015. Pope Francis will be in the Philippines from January 15 to 19.

Catapang said he believed that the NPA would reciprocate their declaration of the Somo.

The all-out law enforcement operations against the Abu Sayyaf and the Bangsamoro Islamic Freedom Fighters will still continue, he said.

Deputy Director General Leonardo Espina, officer-in-charge of the Philippine National Police, said they would “always maintain their defensive posture” in all vital installations.

“We do not want any atrocities from their end to happen in our end,” he said.

A high-ranking leader of the New People’s Army (NPA) was arrested by combined military and police forces in Compostela Valley on Sunday afternoon, the military said.

Jordan Donillo alias Noli or Estong, commander of the Main Guerrilla Force of Guerrilla Front 18, was arrested in Barangay Magnaga in Pantukan on Sunday at 5:35 p.m., First Lieutenant Vergel Lacambra of the Army’s 10th Infantry Division said in a statement.

Donillo was arrested for crimes of double murder and multiple frustrated murder, attempted murder and robbery. He has a P2.5-million bounty on his head.

Lacambra said Donillo was also part of the group that attempted to kill retired Major General Jovito Palparan in 2000.

Major General Eduardo Año, commander of the 10th Infantry Division, lauded the efforts of the AFP and PNP personnel involved in the arrest of Donillo.

Año said it was a “major victory in the campaign to bring justice to the victims of terroristic activities by the CPP-NPA.”

He also assured that Donillo will be accorded rights to due process.
